Claiming Birth Injury Compensation

If you are making a claim for injuries you have sustained during childbirth as a result of negligence, the claim must be brought within 3 years of the date of the alleged negligence or from the date on which you first knew or suspected that you were injured as a result of the alleged negligence.

To make a birth injury compensation claim on behalf of your child, you are able to make a claim at any time before their 21st birthday. However, if your child lacks the mental capacity to manage their own affairs, a claim can be made at any time.

If you’re making a claim because your child sadly passed away due to birth injury, then you have 3 years to make the claim from the date of their death.
