Delay Announced to the Introduction of No-fault Divorce

Introduction of No-fault Divorce Delayed

The Government has confirmed that it cannot meet its own deadline for the introduction of the no-fault divorce legislation. An initial target had been set of Autumn 2021 for the introduction of the long-awaited changes to the UK’s Divorce Law.
The changes would bring an end to the requirement to show unreasonable behaviour or wrongdoing by either party. The Courts minister Chris Philip MP has confirmed that the Government is now working on a commencement date of 6th April 2022.
It is almost a year since the Divorce, Dissolution and Separation Act was passed through parliament. This followed years of campaigning by lawyers to reform the outdate divorce system. The aim of the new legislation is to make the process of Divorce simpler and less confrontational.
Our Divorce and Family Law Solicitor, Noelle Heath commented, “this will be a disappointment for many divorce lawyers who have supported the campaign for a change in the law and more importantly for those couples who have recently separated and may be contemplating divorce. However, these changes have been a long time coming and this will be the biggest reform of divorce law in fifty years, so it is preferable to have a further short delay to ensure that the procedural rules surrounding the legislation are right.”
