Up to 50 jobs lost as CC & RJ Emerson Ltd ceases trading

We are now reading reports that up to 50 jobs have been lost as the Coalville-based trucking company, CC & RJ Emerson Ltd, has completely ceased trading. Miles Needham and John Lowe of FRP Advisory were named joint administrators on Thursday 4 April, the day before CC and RJ Emerson filed a notice of intention to appointment administrators. It is now understood that the company had closed before administrators had been appointed. 

Unfortunately, it is common for administrators to make immediate redundancies, without prior warning or any consultation process. A failure to follow a consultation process could lead to employees being able to claim compensation from an Employment Tribunal of up to 90 days’ pay. Such a claim could be pursued if:

  • 20 or more people were made redundant at the same workplace; and
  • There was no information and consultation process, or it wasn’t carried out correctly prior to making redundancies.
