We will be seeking to recover our costs and disbursements incurred from the debtor.
The steps involved in recovering debts vary from case to case. However, most cases will go through one or more of the below stages:
Stage 1 – Pre action
This is a letter sent to the debtor to resolve disputes and recover your debt without the need for legal action. Where possible, we will aim to recover your debt at this stage to allow for a faster and more cost-effective resolution.
Stage 2 – Court action
If the dispute is unable to be resolved at stage one, court action is usually the next step in the process. Once the court has served the claim, a debtor has up to 28 days in which to file defence. If they fail to acknowledge the claim within 14-days or fail to file a defence after doing so within 28 days, a request can be made to the court for judgment to be entered providing the debtor has not filed an acknowledgement or a defence.
Step 3 – Enforcement
Once judgment has been obtained, enforcement action may be needed to recover the sums awarded by the court.
