Professional Negligence Solicitors

When you hire a professional, the last thing you might expect is to receive negligent service. However, some professionals do unfortunately make mistakes, miss deadlines, or misadvise their clients, which can lead to serious consequences.

Our Professional Negligence Services

We deal with a wide range of claims resulting from professional negligence, but have particular expertise with claims arising from services provided by:

  • Solicitors
  • Barristers
  • Accountants
  • Financial Practitioners
  • Surveyors
  • Construction Professionals
  • Insurance Brokers
  • Under Settled Personal Injury Claims

We have previously successfully handled claims and secured compensation for clients where:

  • Surveyors have failed to properly carry out a client’s mortgage valuation survey. As a result, they missed massive subsidence which led to the property in question being condemned.
  • Accountants have failed to correctly draw up accounts, or to file them in time. This led the business concerned to suffer financial losses and receive penalties from the Inland Revenue.
  • Solicitors dealing with the purchase of a client’s property failed to advise on the position of the property secure the appropriate rights of way.

What is professional negligence?

Professional negligence cases cover a range of areas where a professional has provided you with incorrect or poor advice. Examples of professional negligence include:

  • Your will has been drafted incorrectly
  • Your trust or estate has been wrongly managed
  • You’ve been given incorrect financial advice
  • A professional advises you on matters that are beyond their particular area of expertise
  • An engineer or architect provides you with flawed designs, or fails to spot a design flaw
  • A solicitor misses a crucial deadline for your case
  • A surveyor fails to see a defect when undertaking a pre-purchase survey.

If you have been impacted by poor or negligent advice, contact our expert lawyers to find out more information about your situation.

Can I make a Professional Negligence claim?

When you contact a professional advisor, it is expected that they will approach your case with care and expertise. Of course, no professional can reasonably offer perfect advice 100% of the time, but if you feel you have been given extremely bad professional advice, you may be able to make a claim.

In the case of professional negligence, you can make your case on one of two grounds:

  • If you can prove that another experienced professional in the same field would have offered different advice
  • If you can prove that the advisor in question failed to adhere to the common standards of practice in their field

Often, these matters arise after a professional attempts to give advice on matters beyond their expertise. Our lawyers have years of experience, and will be able to support you through this complex, time-consuming process.

No Win, No Fee Professional Negligence Claims

In some cases, we are able to offer our professional negligence services on a “no win, no fee” agreement. This means that if your claim is unsuccessful, you won’t have to pay anything for our services.

We also offer “after the event” insurance from a market-leading provider. This insurance can guard you against the risk of having to pay the costs of the other side in what is a particularly complex area of law.

What time limits apply in Professional Negligence cases?

Strict time limits apply to professional negligence cases. It is therefore extremely important that you seek legal advice as soon as you become aware of any potential negligence carried out by a hired professional.

Any delays in seeking this advice could adversely affect the value of a potential claim, and could even mean that your claim cannot be pursued at all.
