What is a protective award and am I entitled to one? If 20 or more employees have been made redundant from one place of work, it is a legal requirement for the employer to follow the correct procedures. They must arrange a consultation process with employee representatives to notify them they are at risk of redundancy and consider ways of avoiding redundancies, reducing the numbers or mitigating the circumstances. Failure to do this means employees may be eligible to make a protective award claim.
A protective award is claiming compensation for up to a maximum of 90 days gross pay. When a company is insolvent, up to 8 weeks of these awards can be paid by the Insolvency Service.
