What is the Process of Making a Medical Negligence Claim

So, what is the process of making a medical negligence claim? If you or a loved one have suffered injury, illness or declining health due to mistakes caused by medical professionals, then you may be considering pursing a medical negligence claim to (hopefully) get the answers, apology and compensation you deserve.
The thought of pursuing a medical negligence claim may seem daunting, especially as it’s a process you’re unlikely to have gone through before. However, our expert medical negligence solicitors are on hand to explain the process of making a claim from start to finish.

The Process of Making a Medical Negligence Claim

When you or a loved one have suffered from medical negligence, you may not know which way to turn. Our medical negligence solicitors are here to support you after the incident and will work efficiently to achieve the best possible outcome.
In the UK we are fortunate enough to have one of the best healthcare systems in the world, and due to the standard of our medical and healthcare professionals, medical negligence is rare. However, there are instances where things go wrong and patients receive substandard care from medical professionals, which can cause them unnecessary suffering.
Medical negligence can arise in a number of ways for example, misdiagnosis, delayed treatment, surgical mistakes or prescription errors etc.
Typically, you must start your medical negligence claim within 3 years of the date from which you first knew, or suspected that you had suffered as a result of the alleged negligence. We recommend that you seek legal advice as soon as possible after the incident because failure to do so may prevent you from bringing further action.

So, What is the Process of Making a Medical Negligence Claim?

Below we explain the step-by-step process of making a medical negligence claim:

  1. Contact us – Firstly, you need to contact us with as much information as you can regarding the medical treatment you have received and the injuries you have suffered as a result of that treatment.
  2. Free Initial Consultation – Next, we will arrange a free initial consultation with one of our medical negligence paralegals who will provide clear and honest legal advice based on your potential claim. They will also explain the different funding options available to you.
  3. Speak to a solicitor – One of our experienced solicitors will review your case, including the response to any formal complaint you have made and any other available evidence to determine whether your claim has a good chance of succeeding.
  4. Investigation – We will obtain copies of all relevant medical records and acquire a report from an independent expert in the relevant field of medicine to consider whether the treatment you received fell below a reasonable standard and that you suffered injury because of that treatment. The expert may request to examine you.
  5. Claim Submission – If the expert is supportive of your claim, we will formally put forward a claim on your behalf to the Defendant and await their response.
  6. Negotiation – If the Defendant accepts liability for your negligence medical treatment, we will negotiate a settlement on your behalf to fully compensate you for the injuries you have sustained. However, in the event the Defendant does not accept liability then court proceedings may need to be issued.
  7. Settlement & Payment – Once the negotiation is complete the final stage is to settle the claim and pay the compensation received from the Defendant into your bank account.
