Making a Claim for Cerebral Palsy Compensation

Cerebral Palsy claims must be brought within 3 years of the child’s 18th birthday. If the injury means that the child lacks legal capacity then the limitation period will be stayed until such a time as they regain capacity (if at all).

Can Medical Negligence Cause Cerebral Palsy?

Yes, medical negligence can be the cause of cerebral palsy. Medical mistakes made before, during or soon after childbirth could cause cerebral palsy. Here are the main types of negligent treatment during childbirth, which could cause cerebral palsy:

  • Delay in delivering child causing deprivation of oxygen
  • Delay in diagnosing, treating or misdiagnosis of meningitis
  • Failure to diagnose and treat jaundice
  • Failure to monitor the baby’s heart rate

How are Cerebral Palsy Cases Funded?

Morrish Solicitors has a Clinical Negligence Legal Aid franchise which means we are one of a select group of law firms approved by the Legal Aid Agency to offer Legal Aid funding in certain clinical negligence claims.

Legal Aid for clinical negligence claims is only available in very limited circumstances for:

  • Claims where a child has suffered a severe brain injury during pregnancy/childbirth or within the first 8 weeks of life;
  • Claims deemed to be ‘exceptional’ by the Director of Legal Aid Casework.

If you are eligible for Legal Aid, you will not have to pay anything towards your legal fees. Our team of medical negligence specialists will support you through the process and make the application on your behalf.

Cerebral palsy claims must be brought within 3 years of the date of the alleged negligence or from the date on which you first knew or suspected that you were injured as a result of the alleged negligence.

There are limited exceptions to this rule for claims involving children and protected parties as well as claims brought on behalf of an estate.
